I'm a new player, in teams that allow players with low MP there is a constant turnover, as members need to be kicked and replaced on a regular basis. Maybe not daily, but several times a week. And for those teams it's ridiculous that you can kick and accept new members only if you've just started your war.
And they're not team hoppers. Many of them are (like me) in search of a decent team that can get a few wars together. The player in question didn't even know that there was a cooldown, as you're not told that when you change teams.
I'm not quit sure, what you consider high and low level team, that said I'm still for cd because the only one you didn't brought on to yourself is that you told your team your where going to leave after war and they started a war anyway, that's not nice but it happens.
a person can also be kicked but I assume then the person didn't do what's expected, most serious teams have rules that will be explained to them as soon as they enter a team, if you don't think you can handle them the your not a fit for that team and should look elsewhere on your own and not wait till you get kicked out.
So when you have good leads an co's they check and yes it happens because we are all human but if it happens regularly then maybe you should question them and not the cd rule. A pop-up would be nice like "are you sure you want to start war because there are only X persons eligible". But I still see enough reasons to keep the cd rule around
